The in service quota for the Post Graduate Medical courses were re introduced in the State of Kerala pursuant to the judgment of the Supreme Court of India in Tamil Nadu Medical Officers Association and Ors v. Union of India (2021) 6 SCC 568. The Kerala Medical Officers' Admission to Postgraduate Courses Under Service Quota Act, 2008 deals with the service quota in the State of Kerala. It is as per the provision of this Act the service quota is provided to medical officers for admission to the Post Graduate courses.
In a recent judgment passed by the High Court of Kerala , the court had considered the question whether the Lecturers of Institute of Integrated Medical Sciences ( Government Medical College, Palakkad) is entitled to claim the benefit of Service Quota for the admission to the Post Graduate Medical Courses. The High Court of Kerala in its judgment dated 25.08.2022 had held that, Lecturers of Palakkad Medical College has to be treated for all practical purposes as employees coming directly under the control of Director of Medical Education, Thiruvananthapuram and that they are entitled to secure admission for Post Graduate Medical Courses under Service Quota.
The High Court of Kerala also recently had considered the issue of 50% reservation for candidates who have served in rural/difficult rural areas. In the said case the petitioners had sought for 50% reservation for candidates who have served in rural/difficult rural areas. In the said case the court held that, petitioners cannot claim right to get incentive. It was also held that the petitioners cannot claim sub quota for persons with Difficult and Rural area services as a matter of right.
